Terms of Service

1. Acceptance of Terms

By downloading, installing, or using HUD Live Captioning ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. Use of the App requires authentication via Apple Sign-In, Google Sign-In, or Email/Password.

2. Description of Service

HUD Live Captioning is a mobile application that provides real-time speech-to-text transcription functionality by:

• Converting spoken audio to text using Apple's on-device Speech framework
• Displaying live captions in real-time on your device
• Providing a windshield HUD display mode with mirror-reversed text
• Using OpenDyslexic font for improved readability
• Saving conversation history locally and syncing to Firebase Firestore
• Syncing settings and statistics across devices via Firebase
• Requiring authentication (Apple Sign-In, Google Sign-In, or Email/Password)

3. Safety and Responsible Use

• Driver Responsibility: You are solely responsible for safe operation of your vehicle at all times.
• Primary Focus: Your primary focus must always be on driving and road conditions.
• Distraction Risk: Using this app while driving may be distracting. Use at your own risk.
• Legal Compliance: You must comply with all applicable traffic laws and regulations in your jurisdiction.
• Device Placement: Ensure your device is securely mounted and does not obstruct your view of the road.
• No Liability: We are not responsible for any accidents, injuries, or damages resulting from use of the App while driving.

By using this App, you acknowledge that you understand these risks and agree to use the App responsibly and in compliance with all applicable laws.

4. User Requirements

To use the App, you must:

• Have a compatible iOS device running iOS 17.0 or later
• Create an account using Apple Sign-In, Google Sign-In, or Email/Password
• Have an active internet connection for authentication and cloud sync
• Grant microphone access for audio capture
• Grant speech recognition permission for transcription
• Comply with all applicable laws and regulations

5. User Account and Authentication

The App requires authentication for cloud sync and data storage:

• You must sign in with Apple, Google, or Email/Password to use the App
• You are responsible for maintaining the security of your account credentials
• You agree to provide accurate and complete information
• Your conversation history, settings, and statistics are stored in Firebase Firestore
• We reserve the right to suspend or terminate access for accounts that violate these Terms
• You can delete your account at any time from the app settings

6. Privacy and Data

On-Device Processing

All speech recognition and transcription happens on your device using Apple's Speech framework. We do not collect, store, or transmit your audio or transcription data to our servers.

Cloud Storage

Your conversation history, settings, and statistics are stored in Firebase Firestore and synced across your devices. This data is private to your account and encrypted in transit. We cannot access your conversation content.

Data Deletion

When you sign out, all local data is cleared from your device. When you delete your account, all data is permanently deleted from Firebase.

7. Intellectual Property

App Ownership

The App, including all content, features, and functionality, is owned by Kaden Yokota and is protected by copyright, trademark, and other intellectual property laws.

OpenDyslexic Font

The App uses the OpenDyslexic font, which is licensed under a Creative Commons license. OpenDyslexic is a trademark of Abelardo Gonzalez.

User License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Prohibited Uses

You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Use the App to infringe upon the rights of others
• Interfere with or disrupt the App's functionality or servers
• Use automated systems to access the App without permission
• Use the App as a reference, template, or basis for creating, developing, or designing similar applications or competing products
• Share your account credentials with others
• Create multiple accounts to circumvent restrictions

9. Third-Party Services

The App integrates with the following third-party services:

• Apple Speech Framework: On-device speech recognition (governed by Apple's terms)
• Firebase Authentication: User authentication service (governed by Google's terms)
• Firebase Firestore: Cloud database for data sync (governed by Google's terms)
• Apple Sign-In: Authentication method (governed by Apple's terms)
• Google Sign-In: Authentication method (governed by Google's terms)

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or reliability of third-party services.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of transcriptions
• Warranties that speech recognition will work in all environments or conditions

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or use
• Personal injury or property damage
• Accidents or incidents resulting from use of the App while driving
• Damages resulting from third-party services or content
• Inaccurate or incomplete transcriptions
• Loss of conversation data due to technical issues

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP (IF ANY).

12. Indemnification

You agree to indemnify, defend, and hold harmless Kaden Yokota and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Any accidents or incidents resulting from your use of the App while driving
• Your violation of any applicable laws or regulations

13. Changes to the App

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by updating the "Last Updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App and supersede all prior agreements and understandings.
